1. About Audiophile Wearing
These Terms and Conditions apply to all visitors to and customers of Audiophile Wearing and to all purchases made through:

In these Terms and Conditions, “Audiophile Wearing,” “we,” “us” and “our” refer to the business identified above. “Customer,” “you” and “your” refer to anyone who visits our website or places an order.
Our shop is hosted and technically supported by Fourthwall. Production, payment processing, fulfilment and delivery may be performed by Fourthwall and its selected third-party partners.
By using our website or placing an order, you confirm that you have read and accepted these Terms and Conditions.
Nothing in these Terms and Conditions excludes or restricts any mandatory consumer rights that apply to you.
2. Products
Audiophile Wearing sells print-on-demand clothing, accessories, babywear and other merchandise featuring original audiophile-themed designs.
We make reasonable efforts to display product descriptions, colours, measurements and images accurately. However, colours may look slightly different depending on your screen settings, and the positioning or appearance of a printed design may vary slightly between products.
Minor differences in colour, print position or product appearance that are normal for print-on-demand production are not automatically considered defects.
Product availability may change without notice. We reserve the right to discontinue or replace products at any time.
3. Product Information and Sizes
Customers are responsible for carefully checking all product information before ordering, including:

product type;

size;
-
colour;
-
design;
-
quantity;
-
price; and
-
delivery address.
Where available, please consult the size guide before placing your order. Sizes can vary between brands and product types.
A product is not considered defective solely because the selected size does not fit, provided that the delivered product corresponds with the size ordered and the published size information.
4. Orders
By placing an order, you make an offer to purchase the selected products under these Terms and Conditions.
After placing an order, you will normally receive an electronic order confirmation. This confirmation acknowledges receipt of your order but does not necessarily mean that production has already started.
We reserve the right to refuse or cancel an order where:

a product is unavailable;
-
the price or product information contains an obvious error;
-
payment cannot be authorised;
-
fraud or unauthorised activity is suspected;
-
the order violates these Terms and Conditions; or
-
fulfilment is not reasonably possible.
If we cancel an order after payment has been received, the amount paid for the cancelled product will be returned using the original payment method.
5. Changes and Cancellations
Our products are produced on demand through an automated fulfilment process.
Once an order has been submitted and has entered production, it can no longer be changed or cancelled. This includes changes to:

the product;
-
the size;
-
the colour;
-
the design;
-
the quantity; and
-
the delivery address.
If you notice an error immediately after placing your order, please contact us as soon as possible. We will check whether production has started, but we cannot guarantee that the order can still be changed or cancelled.
Nothing in this section affects a cancellation or withdrawal right that cannot legally be excluded.
6. Prices
The price shown on the product page at the time of ordering applies to the purchase.
Prices may be displayed in different currencies depending on the customer’s location and the available website settings. Applicable taxes and delivery charges will be shown during checkout before payment is completed.
We may change product prices at any time. A price change will not affect an order that has already been accepted, except in the case of an obvious pricing error.
Discount codes and promotional offers may be subject to additional conditions and may be withdrawn or changed at any time. Unless otherwise stated, discounts cannot be combined.
7. Payment
Available payment methods are shown during checkout. Payments are processed securely by Fourthwall or its third-party payment providers.
By submitting payment information, you confirm that:

the information is complete and accurate;

you are authorised to use the selected payment method; and
-
sufficient funds or credit are available.
We do not directly store complete payment-card information.
If payment is refused, reversed or cancelled, we may suspend or cancel the order.
8. Production and Delivery
Production and estimated delivery times shown on the website are estimates and not guaranteed delivery dates.
Delivery times may be affected by:
-
the destination country;
-
the selected product;
-
production capacity;
-
the delivery service;
-
customs procedures;
-
public holidays;
-
severe weather;
-
strikes; or
-
other circumstances outside our reasonable control.
Customers are responsible for providing a complete and accurate delivery address.
If an order cannot be delivered because the customer supplied an incorrect or incomplete address, failed to collect the parcel or refused delivery without a valid legal reason, additional production or delivery costs may be charged.
International orders may be subject to customs duties, import taxes or handling charges. Unless stated otherwise during checkout, these costs are the customer’s responsibility.
9. Made-to-Order Products
Most Audiophile Wearing products are produced only after an order has been placed. This helps reduce unnecessary stock and waste.
Because products are made on demand, we do not voluntarily accept returns or exchanges solely because:

you changed your mind;
-
you ordered the wrong size;
-
you selected the wrong product or colour;
-
you ordered the wrong quantity; or
-
you no longer want the product.
However, being produced on demand does not automatically remove any mandatory statutory right of withdrawal.
Where applicable law gives you a right to withdraw from an online purchase, that legal right remains unaffected.
Products that are personalised or manufactured according to a customer’s individual specifications may be excluded from the statutory right of withdrawal where permitted by law.
10. Statutory Right of Withdrawal
If you are a consumer in the European Union, European Economic Area or another jurisdiction that provides a mandatory cooling-off period, you may have the right to withdraw from an eligible online purchase within fourteen days after receiving the product.
To exercise a statutory right of withdrawal, you must send us a clear statement before the applicable withdrawal period expires. Please include your name, order number, contact details and the products concerned.
After notifying us, eligible products must be returned within the legally applicable period and in accordance with the return instructions provided.
Unless otherwise required by law:
-
the customer is responsible for the direct cost of returning a non-defective product;
-
products may be inspected after return;
-
the customer may be responsible for any reduction in value caused by handling beyond what is reasonably necessary to inspect the product; and
-
refunds will be processed after the returned product has been received or after acceptable proof of return has been provided.
Personalised products and products made according to a customer’s individual specifications may be excluded from this right where permitted by applicable law.
This section does not create an additional voluntary return right beyond the rights required by applicable law.
11. Damaged, Defective or Incorrect Products
If you receive a product that is damaged, defective, misprinted or different from the product ordered, please contact us as soon as reasonably possible through our contact form:

For faster processing, please provide:
-
your order number;
-
a description of the problem;
-
clear photographs of the complete product;
-
detailed photographs showing the reported problem;
-
a photograph of the packaging; and
-
a photograph of the shipping label, where relevant.
Photographs are used only for an initial assessment. We reserve the right to require the physical product to be returned before making a final decision.
Providing photographs does not automatically result in approval of a claim, a free replacement or a refund.
12. Inspection of Reported Defects
Where reasonably necessary, the product must be returned for physical inspection.
Do not return a product without contacting us first. We will provide the correct instructions and return address. Products returned without prior authorisation may be delayed, refused or sent to an incorrect facility.
A replacement will not normally be produced or dispatched until:
-
the returned product has been received;
-
the reported problem has been inspected; and
-
the claim has been approved.
If the product is confirmed to be damaged, defective, misprinted or incorrectly supplied, we will provide an appropriate remedy in accordance with applicable law.
Where permitted by law, replacement of the product will normally be the first remedy offered. Depending on the circumstances and mandatory consumer law, another remedy may be required, such as repair, a price reduction or a refund.
13. Return Shipping Costs
For voluntary, change-of-mind or sizing-related returns that we exceptionally agree to accept, return shipping costs are the customer’s responsibility.
For a reported defect or fulfilment error, the customer may initially be asked to pay the return shipping costs where permitted by law.
If inspection confirms that the product was damaged, defective, misprinted or incorrectly supplied, reasonable standard return shipping costs will be reimbursed where required by applicable law.
If no defect or fulfilment error is found, return shipping costs will not be reimbursed. The customer may also be responsible for the cost of sending the product back to them.
If applicable law requires us to provide a prepaid return method for a defective product, that mandatory requirement will take priority.
14. Refunds
We do not provide refunds merely because a customer:
-
changed their mind outside an applicable statutory withdrawal period;
-
selected the wrong size;
-
selected the wrong colour or product;
-
supplied an incorrect delivery address;
-
no longer wants the product; or
-
expected colours or print positioning to be identical to what appeared on their screen.
Where a refund is legally required or specifically approved by us, it will normally be returned through the original payment method.
Processing times may vary depending on the bank or payment provider.
Nothing in this section excludes a refund or other remedy where it is mandatory under applicable consumer law.
15. Lost or Delayed Shipments
If tracking information shows no movement for an unusually long period or if an order appears to have been lost, please contact us so that the shipment can be investigated.
A parcel is not automatically considered lost merely because it arrives later than the estimated delivery date.
If tracking information shows that a parcel was delivered, we may ask the customer to:

check with other members of the household;
-
check around the delivery location;
-
contact neighbours;
-
contact the delivery company; or
-
provide additional information.
We are not responsible for theft or loss occurring after correct delivery, except where applicable law provides otherwise.
16. Intellectual Property
All Audiophile Wearing designs, illustrations, logos, text, graphics, product images and other original materials are protected by intellectual-property laws.
Unless we have provided prior written permission, you may not:

copy or reproduce our designs;
-
sell products featuring our designs;
-
modify or redistribute our artwork;
-
use our materials for commercial purposes;
-
remove copyright or ownership notices; or
-
use our name, branding or designs in a way that suggests an unauthorised partnership.
Purchasing a product does not transfer any intellectual-property rights in its design.
17. Acceptable Use of the Website
You may use our website only for lawful personal purposes.
You must not:
-
interfere with the proper operation or security of the website;
-
introduce malware or harmful code;
-
attempt to gain unauthorised access to accounts or systems;
-
use automated systems to scrape or reproduce website content;
-
commit fraud or provide false information;
-
impersonate another person; or
-
infringe the rights of Audiophile Wearing, Fourthwall or any third party.
We may restrict access to the website where misuse, fraud or unlawful activity is reasonably suspected.
18. Third-Party Services
Our website, checkout, payment processing, production, fulfilment, tracking or delivery may rely on services supplied by Fourthwall and other independent third parties.
The use of certain third-party services may also be subject to their own terms and privacy policies.
We are not responsible for third-party websites that are not under our control. A link to another website does not mean that we endorse all of its content, products or practices.
19. Privacy
Personal information is processed in accordance with our Privacy Policy and the applicable privacy information provided by Fourthwall and its service providers.
Customers are responsible for ensuring that the information they provide is accurate and that they are authorised to provide it.
20. Liability
Nothing in these Terms and Conditions excludes or restricts liability where doing so would be unlawful, including liability for fraud, deliberate misconduct or mandatory consumer rights.
To the fullest extent permitted by law, Audiophile Wearing will not be liable for:

indirect or consequential loss;

loss of profit, revenue, business or opportunity;
-
damage caused by improper use, washing, storage or handling of a product;
-
delays caused by customs or delivery companies;
-
problems resulting from incorrect information supplied by the customer; or
-
events outside our reasonable control.
Products must be used, washed and maintained in accordance with the product instructions. We are not responsible for damage caused by failure to follow those instructions.
Our total liability relating to a purchase will not exceed the amount paid for the affected product, except where such a limitation is prohibited by law.
21. Force Majeure
We will not be responsible for a delay or failure caused by circumstances outside our reasonable control, including:

natural disasters;
-
severe weather;
-
fire or flooding;
-
war, terrorism or civil unrest;
-
pandemics;
-
strikes;
-
transportation disruption;
-
customs delays;
-
internet or payment-system failures;
-
government action; or
-
interruption at a production or fulfilment facility.
We will make reasonable efforts to minimise the effects of such circumstances.
22. Changes to These Terms
We may update these Terms and Conditions when necessary, for example because of changes to our products, services, website, fulfilment process or applicable law.
The version published on the website at the time an order is placed will normally apply to that order.
Changes will not retroactively reduce mandatory rights relating to orders already placed.
23. Severability
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue to apply.
The invalid or unenforceable provision will be interpreted or replaced as closely as legally possible in accordance with its original purpose.
24. No Waiver
If we do not immediately enforce a provision of these Terms and Conditions, this does not mean that we waive our right to enforce it later.
25. Governing Law
These Terms and Conditions and all purchases made through Audiophile Wearing are governed by the laws of the Netherlands.
If you are a consumer residing outside the Netherlands, you retain the protection of any mandatory consumer laws applicable in your country of residence.
Nothing in these Terms and Conditions requires a consumer to give up the protection or jurisdiction granted by mandatory applicable law.
26. Complaints and Disputes
If you have a complaint, please contact us first and give us a reasonable opportunity to resolve the matter.
Please include:

your name;

your order number;
-
a clear description of the complaint; and
-
any relevant documents or photographs.
We aim to respond within a reasonable period.
If a dispute cannot be resolved informally, it may be submitted to a court with jurisdiction under applicable law.
